INCREASING OF PATENT FEES IN RUSSIA.

On October 5, the Resolution of the Government of the Russian Federation dated September 18, 2024 N 1278 «On Amendments to the Resolution of the Government of the Russian Federation dated December 10, 2008 N 941» (hereinafter — the Resolution N 1278) came into force. The Resolution 1278 amends the Regulation on patent and other fees.

As of October 05, 2024, the fees for registration of intellectual property rights and transactions with them in Russia increasing by 10-15%, and the discount (30%) for electronic filing has been cancelled. In addition to the fee increases and the elimination of the electronic filing discount, the Patent and Other Fees Ordinance has undergone a number of changes.

One of the most significant changes is that the payment of fees for maintaining patents for inventions, utility models, and industrial designs in force is made in a lump sum for 5-year periods: from the first to the fifth year of the patent’s validity, from the sixth to the tenth year of the patent’s validity, from the eleventh to the fifteenth year of the patent’s validity, from the sixteenth to the twentieth year of the patent’s validity, from the twenty-first to the twenty-fifth year of the patent’s validity.

The fee for the first 5-year period shall be paid together with the grant fee. The fee for maintaining a patent for an invention, utility model or industrial design for subsequent 5-year periods of validity shall be paid during the last year of the previous 5-year period of validity of the patent or during an additional 6-month period, provided that the fee is paid in the amount increased by 50%.

The amount of the fee payable for the 5-year period:

Inventions and industrial designs

6-10 years 23000 rubles (~ 240 USD);

11-15 years 52000 rubles (~ 542 USD);

16-20 years 68000 rubles (~ 710 USD);

21-25 years 135000 rubles (~ 1405 USD).

Utility models.

6-10 years 23000 rubles (~ 240 USD).

This procedure for payment of fees shall apply to all inventions, utility models, industrial designs, including patents granted prior to the entry into force of this Resolution.

Paragraph 2 of the Resolution provides for the peculiarities of payment of fees for maintenance of a patent in force if the patentee has already paid fees for an incomplete 5-year period. In this case, it is necessary to pay additional fees for the remaining years of the 5-year period. For example, the maintenance fee for an invention patent has been paid up to and including the 8th year. In this case, it is necessary to pay the fee for the remaining years of the current 5-year period, i.e. for the 9th and 10th years of the patent’s validity. At the same time, the additional fee must be paid within the year of validity of the patent for which the maintenance fee has already been paid, or within an additional period of 6 months. In other words, in this case, when the 9th year is due, the fee for the 9th and 10th years should be paid.
