DESIGN REGISTRATION IN EURASIA

Three easy steps to file a design application to the EAPO:

To obtain an industrial design patent protection in the Eurasian region, one effective way is to enter the regionalphase of industrial design application. This method grants the applicant a single Eurasian patent valid in 7countries of the region: Armenia, Azerbaijan, Belarus, Russia, Kazakhstan, Kyrgyzstan and Tajikistan.For applicants seeking protection in more than 2 of these countries, filing a Eurasian application is deemed themost practical choice. It simplifies the process as there is no need to pay the official fees in each particularcountry of the region and interact with local patent attorneys from each jurisdiction. A single Eurasian applicationis managed by one registered Eurasian patent attorney, with a single procedural fee paid to the Eurasian PatentOffice located in Moscow, Russia. Another advantage is considerable cost savings on design renewals. Forexample, the fee for renewal of industrial design in Russia for 21-25 years is 120,000 RUR (~1300 USD),whereas the fee for the same renewal period for a Eurasian industrial design (covering 7 countries) is 18,000RUR (~200 USD).

Applicants from outside the region must necessarily interact with the EAPO through the registered Eurasian patent attorneys.

• A Eurasian industrial design application can include up to 100 industrial designs in one class of the Locarno Classification.
• Despite the application and substantive examination fees for Eurasian industrial design are higher than such for a Russian design, this is balanced by the broader protection across 7 regional countries and lower maintenance fees compared to maintaining a Russian design in a single country.
