One way to obtain patent protection for an industrial design in Russia is to file a national application for an industrial design. It is mandatory for the foreign applicants to interact with the Patent Office through Russian Patent Attorneys registered with Rospatent.
- Protection for an industrial design is initially granted for a period of 5 years and may be renewed in 5-year increments, up to a 25-year limit.
- Unlike many other jurisdictions, Russian intellectual property law does not provide legal protection for unregistered industrial designs.
- Currently, the protection of industrial designs in Russia can be obtained through a simplified procedure in accordance with the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs.
- An industrial design patent application must relate to a single industrial design or to a group of industrial designs interconnected in such a way that they collectively form a single creative concept.
