ASSIGNMENT, LICENSE, PLEDGE
In Russia, agreements involving transfer of rights, licenses, and pledges are subject to official registration with Rospatent. Our specialists have extensive experience in registering such agreements.
Russian legislation allows for recordal of a notice of a completed transfer of rights rather than an agreement itself. Thus, a patent attorney submits to Rospatent a petition informing on the fact of a completed assignment, signed personally on behalf of Assignor and Assignee on the basis of the respective powers of attorney. In such instance, we only need scanned copies of the PoA from both parties and a scanned copy of the agreement for verification. This approach streamlines the registration process by eliminating the need to physically mail documents.
Questions and Answers:
- Pay the assignment registration fee.
- Submit a recordal request to the Patent Office (we do this electronically, through Rospatent's special service). The request should be either signed by the parties to assignment (in which case the originally signed specimen should be sent by mail in addition) or by their official representative - Russian patent attorney (in which case the hard copy is not required as the document is signed with the electronic signature of our patent attorney)
The official fee for filing an assignment recordal request in respect of an invention, utility model, or industrial design is 3300 RUR (~40 USD) for the first object + 1700 RUR (~20 USD) for each subsequent one in the same assignment.
The official fee for filing an assignment recordal request in respect of a trademark is 13500 RUR (~150 USD) for the first trademark + 11500 RUR (~130 USD) for each subsequent one in the same assignment
